A crucial court ruling challenge over key evidence relating to speeding claims against Secretary of State Chris Huhne has been dropped clearing the way for a CPS decision.

Lawyers for The Sunday Times have dropped their bid to block evidence related to the case being handed over to investigating police.

Detectives say they already have enough evidence to charge the Energy Minister but the CPS said it needed to wait for the outcome of the court challenge before deciding whether to bring criminal charges.

A decision will now be made as to whether Mr Huhne should face charges over claims he asked his estranged wife Vicky Pryce to accept speeding penalty points on her licence so he could avoid a driving ban.

The Lib Dem MP has consistently maintained the allegations are untrue.

At this morning's court hearing, the newspaper's legal team said the production order for the handover of evidence would be complied with in the near future.

If criminal charges are brought, it is unlikely Mr Huhne could remain in his Cabinet position.

Police delivered an initial evidence file to the Crown Prosecution Service in July but after requesting further evidence, the CPS is still to decide on whether Mr Huhne should be charged or not.

A spokesman for the CPS said no charges could be brought while The Sunday Times tried to obtain a judicial review of a crown court ruling made last October ordering it to hand over the evidence.
